Terms of Service

1. Acceptance of Terms

By accessing or using Wishport ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Wishport is a platform that connects people who have ideas for applications ("Wishers") with developers who want to build them ("Builders"). The Service allows:

• Wishers to post application ideas and vote on others' ideas
• Builders to claim wishes and develop them into real applications
• Community engagement through comments, upvotes, and progress updates

3. Beta Program and Transition

3.1 Beta Status

The Service is currently in beta testing. Features, pricing, and availability may change without notice. We provide the Service "as is" during beta with no warranties regarding availability or functionality.

3.2 Free Builder Access

During the beta period, users may upgrade to Builder status at no cost. This is a temporary benefit of participating in our beta program.

3.3 Transition to Paid Service

When we exit beta:

• We will announce the transition at least 1 week in advance
• All beta builders will receive email notification with pricing information
• Builder accounts that do not subscribe after the grace period will be downgraded to Wisher status
• Projects and content will be preserved even if you are downgraded
• You may re-subscribe at any time to regain builder privileges

3.4 No Refund Guarantee

Because Builder access is currently free during beta, there are no refunds to provide. Once paid subscriptions begin, our refund policy will be clearly stated before purchase.

4. User Accounts

4.1 Account Creation

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials.

4.2 User Roles

• Wisher: Can post wishes, comment, and upvote
• Builder: All Wisher privileges plus ability to claim wishes and create projects
• Admin: Platform moderation and management capabilities

4.3 Account Termination

We reserve the right to terminate or suspend accounts that violate these Terms, engage in abusive behavior, or for any other reason at our discretion.

5. User Content

5.1 Content Ownership

You retain all rights to content you post on the Service (wishes, comments, project descriptions, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Service.

5.2 Content Standards

You agree not to post content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malicious code or spam
• Is hateful, discriminatory, or harassing
• Is sexually explicit or violent
• Impersonates others or misrepresents your affiliation

5.3 Content Moderation

We employ AI-powered moderation and community reporting to maintain content quality. Content that violates our standards may be removed, and repeat offenders may be banned.

6. Builder Responsibilities

6.1 Project Limits

Builders may have a maximum of 3 in-progress projects (Planning, In Development, or Beta status) at any time. Complete or abandon existing projects to claim new wishes.

6.2 Project Ownership

Builders own the code and applications they create. The original wish poster has no ownership claims over the implementation, though attribution is appreciated.

6.3 Good Faith Effort

While we don't require completion, builders should make a good faith effort on claimed projects. Repeatedly claiming and abandoning projects may result in penalties.

7. Prohibited Activities

You may not:

• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated tools (bots) to interact with the Service without permission
• Scrape or collect data from the Service without permission
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal purposes
• Manipulate votes or engagement metrics
• Spam or harass other users

8. Intellectual Property

8.1 Ideas and Wishes

Ideas posted on the Service are not protected. Anyone may implement any wish, whether or not they claimed it through the platform. Posting an idea does not grant you any legal protection or ownership.

8.2 Platform IP

The Wishport platform, including its design, code, and trademarks, is the intellectual property of the site owner. You may not copy, modify, or create derivative works without permission.

9. Disclaimers and Limitations

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9.3 No Guarantee of Results

We do not guarantee that wishes will be built, projects will be completed, or that any particular outcome will result from using the Service.

10. Payments and Refunds (Future)

When paid subscriptions begin:

• Pricing will be clearly displayed before purchase
• Subscriptions will be billed monthly or annually as chosen
• Cancellation is allowed at any time; access continues until the end of the billing period
• Refund policy will be stated at time of purchase
• Failed payments may result in downgrade to Wisher status

11. Privacy and Data

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be announced via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by applicable laws. Any disputes should be resolved through good faith negotiation or appropriate legal channels.
